US Service Terms
Effective: 23 October 2026 ยท Version 1.0
About these terms
These standard US Service Terms apply to public website and marketing services supplied by BusyBee Labs Pty Ltd (ABN 68 688 853 723), trading as BusyBeeDoc, to a practice in the United States. We are an Australian company. We do not represent that we have a US office or that our clinical reviewer holds a US medical license.
These terms apply to all US plans. Your Order identifies the plan, selected services, approved scope, fees, third-party costs, start date and support arrangements. It does not replace these terms with a separately drafted contract. Before work or billing starts, we provide the Order and the version of these terms for your express acceptance. Browsing this website or sending a business inquiry does not accept an Order, start a subscription or authorize a payment.
Our Australian service agreement and Australian patient-data platform agreement do not apply to this US offer. Our US Privacy Policy explains how we handle business contact information.
Services and website scope
The plans and inclusions are described on our US pricing page. The standard website build covers one practice location, up to eight initial core pages, agreed copy and two design revision rounds. Ongoing care includes routine content and design edits within the agreed site, maintenance, monitoring, backup checks and support.
Additional locations, migrations, major redesigns, new functionality, translation, photography, printing, advertising and patient-data workflows are separately scoped and priced. We obtain agreement before undertaking additional paid work. Public content requires your approval before publication. Delays in providing information, access or approvals may change the delivery schedule; we will tell you when that happens.
Prices, billing and third-party costs
US prices are stated in US dollars (USD), not Australian dollars. The current rates appear on our US pricing page, and the amount you agree to pay is recorded in your Order. Applicable taxes and separately identified third-party charges are additional. We identify the total and any applicable tax before you commit; this page does not assume a particular tax treatment for every customer.
Launch includes the standard build in its first-year fee. The first 12 months are paid upfront, followed by monthly billing. Growth + Search, Growth + Social and Accelerate are billed monthly from the start. Growth + Social covers one channel. No separate standard website build fee is added to these plans.
Domain registration, hosting subscriptions and other third-party services are additional. Your practice owns its domain and hosting accounts and grants us the access needed to manage the agreed work. Any third-party subscription remains subject to that provider's terms. We identify required subscriptions before work starts.
If an agreed payment remains unpaid 14 days after we notify you, we may suspend our services after at least a further 48 hours' notice. We will explain the impact and the steps needed to restore service.
Term, cancellation and changes
Launch has an initial 12-month term and then continues monthly. You may cancel after the initial term with 30 days' written notice. Growth + Search, Growth + Social and Accelerate are month-to-month and may be canceled with 30 days' written notice. Send notice to hello@busybeedoc.com. There is no separate early-exit fee. Fees already paid are not refunded except where required by applicable law or expressly agreed in the Order.
Separately quoted projects have their scope, schedule, payment and cancellation arrangements disclosed before acceptance. An inquiry about a project does not create a purchase or ongoing plan.
We may end ongoing services on 30 days' written notice, or suspend or end them sooner for a serious breach, a security risk or a legal requirement. We will explain the reason where we are permitted to do so. When our management ends, you retain your practice-owned accounts and remain responsible for their subscriptions. We provide a reasonable handover of your website source and content and remove our delegated access. Separately licensed services do not transfer automatically.
We do not silently replace the terms you accepted. Material changes to prices, scope or these terms require notice at least 30 days before the proposed change and your express agreement before they apply to your Order. Mandatory rights under applicable law are preserved.
Support and working arrangements
Our team works from Australia. Before starting, we agree meeting windows, support channels and response expectations in your time zone and record them in your Order. Ongoing support does not include 24/7 coverage, emergency clinical support, patient inbox management or answering patient direct messages. New functionality and major redesigns require a separate scope.
We discuss hosting regions and overseas administrative access before setup. A public website's delivery network may operate globally; a Sydney-based team or server does not mean every provider processes all information in one country.
Patient data and HIPAA
Standard plans cover public websites and approved marketing content. Patient booking, messages and intake link to your practice-approved systems. Do not send patient records, clinical messages, identifying case examples or other protected health information (PHI) through our business inquiry form, project emails, support channels or standard website backend.
A patient form, embedded booking widget, analytics or advertising tag, integration, or other feature that could involve patient information requires a separate review of its actual data flow before implementation. A public website or a link to an approved system is not, by itself, a determination that HIPAA or other privacy obligations cannot apply.
Where a requested workflow would make us or a supplier a business associate, the necessary business associate agreement (BAA), safeguards, access controls, hosting and support arrangements, notifications, retention and responsibilities must be established before PHI is processed. A vendor subscription or this agreement is not a BAA. Our Australian DPA does not authorize processing US patient information. No US patient workflow is included or enabled by accepting a standard marketing plan.
If patient information is sent to us unexpectedly, contact us promptly. We will restrict its use and work with you on appropriate containment and handling; this does not expand the agreed service scope or remove any obligations that apply by law.
Content, accessibility and outcomes
You provide accurate practice information, confirm the rights and permissions needed for supplied content, and approve public content before publication. Our clinician reviews content for clarity and accuracy. This does not replace your practice's review of its US professional, advertising, privacy and accessibility obligations, and we do not provide legal advice or regulatory certification.
We target WCAG 2.2 AA in design and development. Accessibility also depends on ongoing content and third-party services. We do not guarantee search positions, AI citations, patient numbers, referrals, revenue or a regulatory outcome.
Ownership and confidentiality
Your practice retains its domain, supplied content and practice-owned accounts. You own the custom website source code we deliver and may request a deployable export. Third-party software, fonts, imagery and services remain subject to their licenses. Our pre-existing methods, reusable tools and BusyBeeDoc brand remain ours. We identify any component that requires a continuing license before it is included.
Each party will keep the other's confidential business information private and use it only to deliver or receive the agreed services, except where disclosure is required by law. This duty continues for two years after the engagement ends, without shortening any privacy or other legal obligation that lasts longer. We will not publish a case study or identify your practice as a client without permission.
Responsibility and disputes
Nothing in these terms excludes a right or remedy that cannot lawfully be excluded. Subject to those rights, we are not liable for indirect or consequential loss, and our aggregate liability relating to the services is limited to the fees paid to us in the three months before the event giving rise to the claim, to the extent the law permits that limit.
Neither party is responsible for a delay caused by an event reasonably outside its control. We will communicate the effect and practical next steps. If it continues for more than 30 days, either party may end the affected services on seven days' written notice, subject to fees already due and mandatory refund rights.
Contact us first so we can try to resolve a concern. If it remains unresolved after 14 days, the parties may agree to mediation; this does not prevent urgent relief or exercising mandatory legal rights. These terms are governed by the laws of Victoria, Australia, with non-exclusive jurisdiction in its courts, subject to any applicable law that requires otherwise. There is no mandatory arbitration or waiver of non-excludable rights in these terms.
